OwnYourGame is an ISK seller and often you will find their spam in the local channels in game. Now a danish ISK buyer has taken his purchase to court as he claims that he did not recieve his ISK.

Through PayPal he had purchased ISK for the value of 100.000 DKK or approx 13.500 Euro over a period of 3 months. This is a huge sum of money and speak volumes of what people invest in this game. That aside spending money over a 3 month period and not getting the ISK should have warned him the first time he did nto get the ISK, or as I believe the case is, he did indeed get the ISK but CCP has promtly taken it away from him.

The ruling is that the banks are NOT responsible for purchaes done through PayPal to a third party.

This brings forth a number of points one of which is that using PayPal is not a guaranteed transaction under danish law which makes perfectly sence, but which should warn all users of PayPal that you should be ready to part with whatever money you use in PayPal related transactions.

What is even more important, from a gaming perspective, is that if you buy ISK you will risk loosing your money. This must not come as a surprise. ISK buyers buy electronic items of a company that deliberate break the EULA of another company and expect these companies to act honestly ?

The conclusion must be: DONT BUY ISK !!!

Østre Landsret har i dag afsagt en principiel dom om brug af et VISA/Dankort til forudbetaling for en ydelse købt over Internettet. Sagen handler om, hvorvidt en sådan betaling foretaget med elektroniske penge via Internetfirmaet PayPal kan kræves tilbage af kortholder overfor det kortudstedende pengeinstitut, fordi den købte ydelse ikke leveres. Forbrugerombudsmanden har i sine retningslinjer af 16. december 1996 vedrørende fjernsalg m.v. i betalingssystemer med betalingskort bestemt, at pengeinstituttet skal foretage tilbagebetaling i sådanne situationer – såkaldt charge back, men Østre Landsret nåede frem til, at Forbrugerombudsmandens retningslinjer ikke fandt anvendelse i den pågældende situation.

Der var tale om manglende levering af varer i form af virtuelle ydelser, som køberen havde betalt og bestilt hos spilfirmaet OwnYourGame til levering i internetspillet EVEonline. Betalingen var foregået ved brug af køberens VISA/Dankort gennem PayPal, der er udbyder af og formidler betalinger med elektroniske penge. De virtuelle ydelser, som havde en samlet værdi af ca.100.000 kr., var købt over en periode på ca. 3 måneder ad flere omgange. Da der efter flere rykkere fortsat ikke skete levering, rettede køberen henvendelse til Nordea Bank Danmark A/S (”Nordea”), som var udsteder af hans VISA/Dankort, med anmodning om, at Nordea foretog charge back i overensstemmelse med Forbrugerombudsmandens retningslinjer.

Nordea meddelte, at betalingen for de virtuelle ydelser var sket gennem PayPal, og at betalingen derfor var sket med elektroniske penge og ikke med et betalingskort. Efter bankens opfattelse fandt Forbrugerombudsmandens retningslinjer derfor ikke anvendelse.

Køberen indgav herefter en klage til Pengeinstitutankenævnet, som i en flertalsafgørelse forpligtede banken til at betale pengene tilbage. Nordea ønskede dog ikke at være bundet af Pengeinstitutankenævnets afgørelse, og Forbrugerstyrelsen indbragte derfor sagen for Københavns Byret, som henviste sagen til Østre Landsret. Under landsrettens behandling indtrådte Forbrugerombudsmanden som biintervenient til støtte for køberen, medens PBS International A/S indtrådte som biintervenient til støtte for Nordea, der var repræsenteret af Finansrådet.

Det blev under sagen bl.a. oplyst, at VISA havde indgået aftale med PayPal om modtagelse af VISA-betalinger, men ikke om at videreformidle VISA-betalinger. Det blev endvidere oplyst, at VISA ikke havde indgået aftale med spilfirmaet om modtagelse af VISA-betalinger, og at spilfirmaets hjemmeside, ikke indeholder et VISA-logo. Køberen kunne derfor alene betale for de virtuelle ydelser med sit VISA/Dankort, såfremt han betalte gennem PayPal.

Landsretten gav Nordea medhold under sagen, idet retten i modsætning til Pengeinstitutankenævnets flertal fandt, at Forbrugerombudsmandens retningslinjer ikke kan anvendes i den konkrete sag. Nordea havde derfor ikke efter disse retningslinjer pligt til at foretage charge back.

Landsrettens afgørelse i sagen er begrundet således:

Forbrugerombudsmandens retningslinjer vedrørende fjernsalg m.v. i betalingssystemer med betalingskort af 16. december 1996 er udstedt i medfør af den dagældende lov om be­talingskort § 12 a, stk. 2 (nu betalingsmiddellovens § 4, stk. 3) og den dagældende markedsføringslovs § 17 (nu markedsføringslovens § 24).

Det fremgår af ordlyden i Forbrugerombudsmandens retningslinjer pkt. 1, at disse finder anvendelse i betalingssystemer med betalingskort. Det er endvidere forudsat, at der skal ske en ajourføring af retningslinjerne, før disse kan finde anvendelse på elektroniske beta­lingssystemer uden betalingskort. Da en sådan ajourføring ikke er foretaget, må det lægges til grund, at retningslinjerne kun finder anvendelse på betalinger foretaget i betalingssy­stemer med betalingskort.

Hverken Forbrugerombudsmandens retningslinjer eller lovteksten eller bemærkningerne til lov om betalingskort, har nærmere defineret begrebet ”betalingssystem med betalingskort”.

Landsretten finder imidlertid at en naturlig forståelse af begrebet fører til, at et betalingssystem alene omfatter de parter, der udover kortudsteder har indgået aftale med denne om at afgive, modtage eller formidle en betaling ved brug af betalingskortet.

Det er under sagen ubestridt, at kortudstederen, VISA, ikke har indgået en indløsningsaftale med OwnYourGame, og at OwnYourGame derfor ikke er berettiget til at modtage betalin­ger, der foretages med et VISA-kort. Det er endvidere oplyst, at VISA og PayPal har indgået en ind­løsningsaftale, men ikke en formidlingsaftale, og at PayPal derfor alene er berettiget til at mod­tage betalinger, der foretages med et VISA-kort. Under disse omstændigheder finder landsretten, at Forbrugerombudsmandens retningslinjer, der er blevet til efter forhandling med de berørte parter, ikke kan udstrækkes til at gælde i forhold til en betalingsmodtager, der ikke er omfattet af det pågældende betalingssystem.

Det bemærkes herved, at [NAME] med sit VISA-kort har købt og fået leveret e-penge af PayPal. Den omstændighed, at PayPal efter aftale med [NAME] har benyttet de købte e-penge til at betale de ydelser, som han har købt hos OwnYourGame, er visasystemet uvedkommende. Den omstændighed, at der er en tidsmæssig sammenhæng mellem [NAME] køb af e-penge og disses anvendelse til betaling for ydelser leveret af OwnYourGame, kan ikke føre til et andet resultat.

Som følge heraf tager landsretten den af Finansrådet som mandatar for Nordea Bank Danmark A/S nedlagte frifin­delsespåstand til følge.

Lately I have been extremely pleased with my new little bird the Ishkur. It handles well, tanks well and deal damage to unsuspecting ships in an inferno of drones and blaster slugs.

Ive been patrolling the same systems and beholding the same gate over and over. Ive found this specific spot, where the sun plays under a nearby station, that I enjoy.

A decision has been reached. I will leave the Ore Mongers behind me. They should not harbor a discontent corporate member and in all fairness have been good corp mates though the period I have been in Ore Mongers. The period have been one in turmoil due to moving to Venal only to move back to unregulated low security space and much time has been spend moving back and forth. Not the ideal time to take in new people, but they did not plan for this.

The choise was made and I promtly send my CEO a note of resignation as there were no need to hold it up. He was a bit baffled by my sudden resignation but took it cool and wished me luck in my future endavors.

A mercenary is what I over time have become and what I am, and although some do not think piracy a proffession unrelated to my own it is by far not the same . A mercenary sells his service to the highest bidder and often fight against the odds, where pirates chose targets of opertunity and prey on the weak. Not an all fair comparison as I also know pirates that fight against overwhelming odds. It is however time to face this fact that I am a mercenary and not a pirate.

But how does one go about offering the service of a single pilot?

I pondered this and other questions as I loaded up my trusty old megathron that now is fitted with close range and high damage blasters. Huge things that can propel the munition a short distance but at extreme velocity. Coupled with an extreme double repairing ability it is a monster to be reckoned with.

I had not even made 5 jumps before I was contacted by Qrell of White Core. White Core is made up by elements of my former corporation FM-C and led by Large Shadow who helped me get my stuff out of stain when I left FM-C.

Qrell offered me employment on the spot but for some reason I was hessitant. The idea of joining as large an alliance as White Core for some reason did not appeal to me. On the other hand I would love to fly with Qrell again.

For the moment I am looking around and talking to old and new friends to see what stirs. Maybe call up Ombey to hear what he is up to. Its time to top off the tank and head into space…

Leaving the Venal station in Y-4 behind in our carriers, we ventured into the low security lawlessness of the Placid region.

Its a strange feeling to roam the space lanes looking for prey. But never the less I assumed patrol duty much like I had in my mercenary days. The new ships of choice were the small nifty assault frigates who for some time has been frowned upon, but recent changes to the design has made them very viable fighters.

After some days of patrolling and running into a new phenomenon called sentry towers I was lonely.

My new corp and alliance were active mostly when I had to power down my ship and when I saw my chance for some fighting it was a long roam they were about to set out on.

I was disillusioned, when the opportunity offered it self. Minmatar Mafia was moving out in my old region Geminate and I at once offered to clone jump to Geminate and head out in one of the ships I still had located in the area.

Much to my surprise I got told off. Pin Wang of Minmatar Mafia informed me that he did not fly with new inexperienced guys. I admit that I am not as experienced on small scale fleet combat as Minmatar Mafia that work as a tight knit unit, but one have to start somewhere. The place to start was obviously not in Minmatar Mafia. For a while I sat as physically hit, waiting for InSession to tell this pilot to stand down and treat a fellow alliance mate fairly or even straight out ask me to join in the roam.

I sat in my Taranis some 6-8 jumps from the Minmatar gang and felt the darkness move in.

Ive never felt betrayed before but for the first time in my life I did.

I told Pin to put his head where a sun never shines and headed back to empire. I quickly docked and just told the hangar crew to undock me in my emergency pod.

I warped to a nearby sun and considered my options while staring at the hypnoticing effect of sun flaes exploding into space.

Ill be damned I thought and decided that such an event would not send me running but to be frank the event nagged me as I headed back for Placid.

Arriving at the gate of the region I stared at the sun reflecting in the armor plates.

For a few more days I have lingered but frequently stop by the gate to behold it. It tells the story of a promised land. I shall hang by it for a few days to see what it tells me. I think it tells me that my future lies in the horizon.

My crow was in a lazy orbit around the station in the Y-4 solar system that Ore Mongers called home. I had only a few days before seen Ombey undock in Varuna jumping to an unknown destination. I felt left alone for the first few days but made an effort to fit in into the new corporation which by all standards is very different from any previous experience I’ve had in dealing with corporations.

On a side note, what in space is that for a name? No numbers in the name to give hint to his obvious Caldari ancestors or even a single W, X or Z. What has happened to good old Caldari names like L33T4tlmachineOo32 ??

Anyway the corporation is more of a loose coalition of independent pilots that each have an agenda and then come together to lift common projects from time to time.

Me, being a pack animal, find this very intimidating. I work best in small and medium groups I must admit but have begun to fly out on my very own. I even got a solo kill on a slow covert OP.

General Spaz of the Minmatar Mafia and I also has a run in with a caracal.

I also had to say goodbye to a Manticore.

It was built from what could be found on the Y-4 market and the intention was to kill a hauler or two coming through 6NJ next door to Y-4. It never got that far.

Last night Tobias ordered the slow evacuation from Y-4 and so far it has progressed fine, with minor incursions from the new inhabitants, who are eager to take the space in possession. The reason for relocation is that Black Hand is made up of very few corporations and only Ore Mongers seem satisfied with having a bit of space. I personally don’t care about owning space.

We are moving to a new region that I have no prior knowledge of but both Minmatar Mafia and Ore Mongers leadership seems satisfied with the region and I guess so am I.

I’ve been more or less absent for almost three full weeks due to a Jita incident involving some trade to Motsu and Kakakela. I had to rush to Jita and help the Gallente girl sort out the business. I managed to come out on top and could pay up front for a Falcon, 2 x Ishtars, 2 x Taranis, 1 x Manticore, 1 x Buzzard, 1 x Hurricane and 1 x Cerberus. I have very high hopes for the Cerberus while I assume I will lose an Ishtar or maybe even both before I can fly that to any good degree. The Falcon I feel fairly confident in and the Hurricane I don’t know what to expect of after most weapons systems have been overhauled.

I hope to be way more active in the comming weeks and also keep the Captains log updated.

Also I may have to rework the intercom design as I am no longer a mercenary by the very definition.

A new day in a new life has begun.

A life not much different but then again aspects of this new life is are indeed very new. I have left behind the epic fleet battles and will sourly miss the special feeling, that is when a fleet undocks and prepares for fight.

The special feeling when you fly next to a titan and prepare to jump into an often hostile location. All senses are fully alert and it almost a narcotic flowing though your veins when the Fleetcommander tells you to jump.

Juturna traveled though the outlaw sectors of skirts of Empire controlled space and I was by far not comfortable with this unregulated space. Some of the more spetacular arrivals using the jumpdrive brought picctures to the mind of the Nyx crashing into the Caldari station spakring the begining of the war in empire.

I have arrived in what we claim as our home. The system of Y-4CFK is controlled by the Guristas and they grant docking rights to anyone who will let a few isk slip in their direction.

My new home has already delivered what was promised. Fast paced combat in small agile fleets. In my first two days I hhave lost a ship and downed three.

Also very noticable is the development in the corp and the alliance as a whole. There is a huge influx of people and everyone is very optimistic. Learning and teaching goes hand in hand and even very new pilots can join up as long as they have the right attitude.

For the moment I am looking at the horizon and it seems bright.
